Petitioner seeks bail in Sheohar P.S. Case No. 76 of 2017 for the offence punishable under Sections 365, 366A/34 of the Indian Penal Code.

Informant is the Mother of the victim girl who had stated that her daughter Priyanka Kumari passed the school examination from the Kasturba Madhya Vidyalaya, Chamanpur. Her daughter was missing from the house from 10.05.2017, and the victim girl Priyanka Kumari returned with the petitioner and in her statement under Section 164 of the Cr.P.C had stated that she had gone with the petitioner out of her own volition and sweet will and they have solemnized their marriage in Sitamarhi Janki Mandir, and thereafter they are

Patna High Court Cr.Misc. No.49025 of 2017(2) dt.17-10-2017 2/2 living as husband and wife. The medical board had assessed the age of the victim girl to be 17 to 19 years. As per the school records the date of birth of the victim girl is 12.02.2000. Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 76 of 2017.
