The petitioner seeks bail in Industrial Area (Auodeogik Prakashetrya) P.S. Case (Excise-175 of 2018), instituted for the offence under Section(s) 30(a) of Excise Act, pending n the court of learned 2nd Additional Sessions Judgecum-Special Judge of Excise, Bhagalpur. It is alleged in the written report that huge quantity of foreign liquor has been recovered from Tata-407. Petitioner was driving the said Tata 407 and he was not having any valid paper with regard to aforesaid illicit liquor. The seizure list is part of the First Information Report.

From the seizure list it appears that huge quantity of

Patna High Court CR. MISC. No.15904 of 2019(2) dt.26-03-2019 2/2 liquor has been recovered from the vehicle on which the petitioner was driver.

Therefore, this Court is not inclined to grant bail to the petitioner at this stage.

Prayer of the petitioner for grant of bail stands rejected.

Petitioner may renew his prayer for bail after six months in the event no substantive progress is made in the trial. (Sanjay Priya, J) S.Ali/- U T
