The petitioners apprehend their arrest in Bhagwanpur P.S. Case No. 217/2015, registered for the offences punishable under Section 302 and other sections of the Indian Penal Code. The informant named fifteen persons and alleged that they all indiscriminately assaulted his brother on different parts of his body and his brother Chandeshwar Mahto got grievous injuries, who died in P.M.C.H. during the course of treatment. Learned counsel for the petitioners submits that four female accused and male accused Ganesh Mahto and others have already been granted anticipatory bail vide orders passed in Cr. Misc. 5325/2016 and Cr. Misc. 13130/2016. The case of
Patna High Court Cr.Misc. No.21133 of 2016 (3) dt.20-07-2016 2/2 petitioners stands on the same footing.
Considering the facts aforesaid and the fact that similarly situated ten accused persons have been granted anticipatory bail and other three persons have been granted regular bail and the case of the petitioners stands on the same footing, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali in connection with Bhagwanpur P.S. Case No. 217/15, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
