JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Maheshkhunt P.S. Case No.150 of 2019 registered for the offence punishable under Sections 341, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is in custody since 30.12.2019. It is alleged in the First Information Report that altogether eight accused persons, four named and four unknown, came in four motorcycles and attempted to drag the informant from the place of occurrence. Allegedly, on an exhortion made by co-accused Balram Chourasiya to kill the informant, co-accused Pranav Kumar Ranjan @ Viveka Chourasiya opened fire targetting the informant, which he narrowly missed.
Patna High Court CR. MISC. No.16117 of 2020(2) dt.02-06-2020 2/2 Mr. Viveka Nand Singh, learned counsel appearing on behalf of the petitioner has argued that there is no specific allegation against the petitioner of having assaulted the informant, though such allegation is there against others. He has further submitted that co accused Rajeev Kumar Poddar has been allowed regular bail by this Court by order dated 04.03.2020 passed in Cr. Misc. No. 14810 of 2020. Considering the above submission and the nature of allegation, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-I, Khagaria, in Maheshkhunt P.S. Case No. 150 of 2019.
