Mr. Mritunjay Kumar For the Opposite Party/s :
Mr. Arun Kumar Mr. Paras Nath ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.
19-09-2018 Heard Sri Mritunjay Kumar, learned counsel for the petitioner, Sri Arun Kumar, learned Addl. Public Prosecutor as well as Sri Paras Nath, learned counsel for the informant. This is the 2nd attempt for grant of bail. Earlier, on 20-11-2017, the prayer for bail of the petitioner rejected, vide Cr. Misc. No. 55415 of 2017, considering the fact that there was accusation against the petitioner that he fired in the occurrence as well as the fact that petitioner was having criminal antecedent.
Learned counsel for the petitioner submits that despite the fact that case has already been committed to the court of sessions, no progress has taken place.
Considering the fact that in view of seriousness of the
Patna High Court Cr.Misc. No.39303 of 2018(2) dt.19-09-2018 2/2 accusation and antecedent of the petitioner, earlier the prayer for bail of the petitioner was rejected, there is no reason to review my earlier order. However, while dismissing the petition for bail, it is desirable to observe that learned Trial Court may proceed with the case expeditiously so that the trial may come to its logical end without unnecessary delay. With above observation, the prayer for bail stands dismissed.
