JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered under sections 467, 408, 471, 419, 420 and 409 of the Indian Penal Code.

It is alleged that the motivator of C.S.P. Branch of S.B.I in connivance with local Mukhiya has duped about hundred fifty beneficiaries under the Indira Awash scheme. It is alleged that Abhishek Anand, being the convenor of the Bank gave only Rs. 10,000/-, whereas the withdrawal slip suggests withdrawal of Rs.27,500/-. Considering the fact that the withdrawal was made by co-accused Abhishek Anand, the similarly situated accused, namely, Niranjan

Patna High Court Cr.Misc. No.26849 of 2015 (2) dt.21-07-2015 2/2 Kumar, son of Ashok Kumar, has been granted anticipatory bail-vide order dated 16-7-2015 in Cr.Misc.No. 26187 of 2015.

Considering the fact that there is accusation against co-accused Abhishek Anand for fraudulently withdrawing the money from the Bank, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad, in connection with Makdumpur P.S. Case No. 14 of 2015, subject to the conditions as laid down under section 438(2) Cr.P.C.
