This is an application for bail in connection with Durgavati P.S.Case No. 149 of 2017 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. Allegation against the petitioner is of recovery of stolen Bolero vehicle from possession of the petitioner and further it appears that he is accused in three other cases also. Submission of learned counsel for the petitioner is that seizure list shows that seizure was made from Toll Plaza and though he is accused in three other cases but the cases are different in nature and he is in custody since 27.7.2017. Heard learned APP also, who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.52543 of 2017 (3) dt.21-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed in this case, learned trial court shall release the petitioner on bail to its own satisfaction with an undertaking that petitioner will co-operate in trial and appear on each and every date, except showing any genuine reason.

With the above observation, this application is disposed of.
