The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, it is stated by the informant that soon after his son went out talking on his mobile phone, sound of gun shots were heard and on going out he saw his son in an injured condition and 3-4 accused persons running away. On being taken to the hospital, he was declared dead by the doctors.

It is submitted by learned counsel for the petitioner that the F.I.R was registered against 3-4 unknown persons. The name of the petitioner transpired in the confessional statement of coaccused Farhan Faridi. Even as per the said confessional

Patna High Court CR. MISC. No.27200 of 2021(3) dt.23-11-2021 2/2 statement the allegations against the petitioner and others are general and omnibus in nature. No incriminating material has transpired against the petitioner in the investigation. The petitioner is in custody since 3.2.2021 and investigation in the case has concluded.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation, the petitioner having remained in custody for over 9 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Buxar Town P.S. Case no.83 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
