2. The petitioner is in custody in connection with Raxaul P.S.Case No.15 of 2017 registered for an offence punishable under Sections 307 and ancillary Sections of the IPC.

3. It is alleged that this petitioner who happens to be neighbour of the informant misbehaved the daughter of the informant. She came to her house and disclosed about the occurrence to her father. Thereafter the informant along with his son went to the place of this petitioner where this petitioner and his father assaulted him and his son causing injury on his head.

4. Learned counsel for the petitioner submits that on account of previous enmity, the informant is in habit of filing case after case. The wife of informant filed a complaint case no.11 of

Patna High Court Cr.Misc. No.57456 of 2017 (2) dt.14-12-2017 2/2 2017 on the basis of which an FIR bearing Raxaul P.S.Case No.32 of 2017 was registered. In the said case, this petitioner was apprehended and he was allowed bail on 13.12.2017 in Cr.Misc.No.57325 of 2017. The informant has filed the present case with similar allegation. The allegation of assault is omnibus and he is in custody since 26.08.2017.

5. The learned APP opposed the submission.

6. In the facts and circumstances, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Raxaul at East Champaran, Motihari in connection with Raxaul P.S.Case No.15 of 2017.
