JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and learned counsel for the informant and learned APP for the State. Petitioner seeks bail in connection Belsand P.S. Case no. 122 of 2020 registered for the offence punishable under sections 363, 366A and 506/34 of the Indian Penal Code. Learned counsel for the petitioner at the outset submits that petitioner is in custody since 07.01.2021 and is person with clean antecedent and charge sheet has been submitted. Learned counsel for the petitioner next submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that occurrence is of 11.10.2020 and FIR has been instituted on 04.11.2020. Further victim in her statement recorded under section 164 Cr.P.C also does not support the allegation of kidnapping. He further submits that the victim and the petitioner

Learned counsel for the informant on instruction submits that he has no objection, if petitioner is enlarged on bail. Considering the facts that petitioner is in jail custody since 07.01.2021, charge sheet has been submitted and learned counsel for the informant does not oppose the bail application, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Belsand P.S.
