This application for grant of anticipatory bail arises out of Jokihat P.S.Case No. 292/2014, disclosing offences under sections 409, 420 and 120B of the Indian Penal Code.
Learned Addl. Public Prosecutor, appearing on behalf of the State, submits that the charge sheet has already been submitted in this case against the co-accused persons including this petitioner.
Learned Senior counsel, appearing on behalf of the petitioner, submits that the petitioner being the Government servant, there is no chance of him fleeing from the course of trial. He further submits that since the charge sheet has already been
Patna High Court Cr.Misc. No.24851 of 2015 (3) dt.08-02-2016 submitted, there is no question of tampering with the evidence by the petitioner in view of nature of accusations against him, which are mainly based on documents.
Considering the submissions, as above, and the facts and circumstances of the case, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Araria in connection with Jokihat P.S.Case No. 292/2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
