====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner seeks bail in connection Khagaria (Chitragupt Nagar) P.S. Case no. 932 of 2020 registered for the offence punishable under sections 461, 380 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is person with clean antecedent and is in custody since 10.12.2020 and charge sheet has been submitted. Learned counsel for the petitioner further submits that allegation against this petitioner in FIR is that the informant alleges that on 10.12.2020 in the morning he saw the petitioner running away from the temple. He raised hulla and on chase this petitioner

Patna High Court CR. MISC. No.27933 of 2021(2) dt.22-11-2021 2/2 was apprehended and from whose possession a silver Jhap and crown of divine mother were recovered. He next submits that the petitioner is a poor person and has been falsely implicated in the case of theft.

Learned APP opposed the prayer for bail.

Considering the facts that petitioner is in jail custody since 10.12.2020, charge sheet has been submitted and petitioner is a person with clean antecedent, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Khagaria (Chitragupt Nagar) P.S. Case no. 932 of 2020.
