The petitioner seeks bail in connection with Katra P.S. Case No. 109 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 435, 153(A), 295(A) & 504 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case in short is that on 08-05-2020, petitioner and other co-accused persons were emptying the pool and killing the fish of the informant. On protest, petitioner assaulted the informant by means of butt of the pistol. It is

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28-11-2023. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation against the petitioner. There is general and omnibus allegation against the petitioner. There is case and counter case between the parties. It is lastly submitted that charge sheet is submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Katra P.S.
