The petitioner seeks bail in a case registered for the offence under Sections 25(1-b)a/26 of the Arms Act. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner is rotting in judicial custody since 10.01.2020.

Learned A.P.P. for the State has opposed the prayer for bail and submitted that one country made pistol along with two live cartridges have been recovered from the

Patna High Court CR. MISC. No.15166 of 2020(2) dt.03-03-2020 2/2 conscious possession of the petitioner.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. However, the petitioner is at liberty to renew his prayer for bail after framing of charge.
