The petitioner seeks pre-arrest bail in connection with Karakat P.S. Case no. 45 of 2016 registered under Section 409 of the Indian Penal Code.
It is contended that the Block Education Officer has not taken any steps regarding procurement of the folder as required by the Department of Vigilance for inspection and in a routine manner he has made the petitioner and others accused in the present case for no fault on their part. The petitioner is a responsible government employee and is not likely to abscond or tamper with the evidence. It is also submitted that the co-accused
Patna High Court Cr.Misc. No.21587 of 2016 (3) dt.14-07-2016 2/2 Guput Nath Singh having identical allegation has been granted pre-arrest bail by a Bench of this Court vide order dated 23.05.2016 passed in Criminal Misc. No. 22899 of 2016. Learned counsel for the State has opposed the application for grant of pre-arrest bail. However, after goring through the case diary, he concedes that the case of the petitioner is on identical footing to that of the petitioner. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner Ram Awdhesh Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bikramganj in connection with Karakat P.S. Case No. 45 of 2016, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Ashwani Kumar Singh, J) Pradeep/- U T
