JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Dumraon P.S. Case No. 177 of 2018 for the offence under Sections 30(a), 41(i) Bihar Prohibition and the Excise Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case liquor was seized from the motorcycle of the petitioner and from the septic tank of the school as well as from the government pond. Learned counsel submit that nothing was recovered from the conscious possession of the petitioner, he has in custody since 15.05.2018.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 15.05.2018, the petitioner, named above, is directed to be released on bail on furnishing

Patna High Court Cr.Misc.
