This application, for grant of anticipatory bail, arises out of Karakat P.S. Case No. 45 of 2016, disclosing offence under Section 409 of the Indian Penal Code. .
The petitioner is said to have not furnished the attested folders of the documents relating to appointments made to the post of Panchayat Teachers in Deo Gram Panchayat in DistrictRohtas to the Vigilance officials. The Vigilance Department is investigating into the irregularities committed in appointment of Panchayat Teachers. Petitioner is a Panchayat Secretary. Learned counsel for the petitioner has submitted that he made available to the Block Education Officer, all such
Patna High Court Cr.Misc. No.22031 of 2016 (4) dt.12-08-2016 documents of which he had taken over charge after he joined as Panchayat Secretary in Deo Gram Panchayat. He has also stated that in similar circumstance, co-accused have been granted anticipatory bail by this Court.
In view of the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj in connection with Karakat P.S. Case No. 45 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner, above named, shall present himself/herself before the police/Court, as the case may be, as and when required and in the event of failure on his/her part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
