Petitioner, already in custody, seeks bail in connection with Pakridayal P.S. Case No.110 of 2015 registered under Sections 302, 120 and 120(B) & 34 of the Indian Penal Code. The FIR is against unknown and the petitioner's name has transpired in the confessional statement of a co-accused. Learned counsel for the petitioner submits that the alleged occurrence is dated in between 06.08.2015 and 07.08.2015, this petitioner was in custody on that day in connection with Patahi P.S. Case No.116 of 2013, except disclosure of his name by co-accused Chandan Kumar Singh, there is no other material against him, Chandan Kumar Singh has been admitted to bail by a coordinate Bench of this Court vide Cr.

Patna High Court Cr.Misc. No.57999 of 2017 (2) dt.15-12-2017 2 /2 Misc. No.42483 of 2017 on 19.09.2017 and charge-sheet has been submitted against the petitioner.

Having considered the aforesaid facts and circumstances, petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Pakridayal P.S. Case No.110 of 2015.
