JUSTICE ARUN KUMAR ORAL ORDER 04-07-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody seeks bail in Paliganj PS Case No. 257 of 2017 S.T. No. 361 of 2018, registered under Sections 304B and 201/34 of the IPC.

The allegation in brief is that the accused persons used to torture informant's daughter married with younger brother of the petitioner and after killing her dead body was disposed of. Learned Counsel for the petitioner submits that there is no specific accusation against the petitioner, who happens to be elder brother of the deceased husband and lives separately from his brother and father-in-law, moreover mother-in-law has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 22043 of 2018. Having considered the said facts and circumstances, the petitioner, namely, Shailenda Bhagat is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Danapur in connection with Paliganj PS Case No. 257 of 2017, S.T. No. 361 of 2018.
