JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken under Section 498A of the Indian Penal Code.

The prosecution case is that the complainant solemnized marriage with Deepak Malakar on 25.5.2015 and for a month she resided together happily, thereafter the accused persons including the petitioners being mother and brother of Deepak started inflicting torture.

No.21713 of 2016 (2) dt.16-05-2016 2/2 It is submitted by the learned counsel for the petitioners that petitioner no. 1 is widow lady and since Deepak got employment in Railways hence in order to put pressure for marriage the accusation has been levelled. It is further submitted that actually the marriage has not been solemnized. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the thrust of accusation against co accused Deepak Malakar, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Danapur, Patna in connection with Complaint Case No. 1375 C of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
