The petitioner seeks regular bail in connection with Khajauli P.S. Case No. 80 of 2017 for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code and sections 25(1-B)A, 26 and 35 of the Arms Act. The accusation against the petitioner is that the Police had got secret information that some persons had assembled to commit dacoity and they were armed with pistol etc. Thereafter the Police is said to have reached at the place of occurrence and conducted a search whereupon the petitioner was apprehended alongwith other accused persons and from whose possession some arms were recovered.

Learned counsel for the petitioner submits that the

No.49691 of 2017 (2) dt.17-10-2017 2/2 petitioner has a clean antecedent, the motorcycle said to have been recovered from his possession belongs to him for which he has annexed registration certificate and insurance cover. It is further submitted that the petitioner is innocent and is languishing in jail since 29.07.2017.

For the reasons stated hereinabove, I deem it fit and appropriate to enlarge the petitioner, namely Kishan Raj Singh @ Kanhaiya Singh on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Madhubani in connection with Khajauli P.S. Case No. 80 of 2017.
