ANJANA MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 15.06.2017 in connection with Sour Bazar P.S. Case No.158 of 2017 registered for the offence under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been arrested on mere suspicion on the basis of the confessional statement of co-accused, namely, Md. Haidar Ali, which cannot be accepted as evidence. Learned counsel for the petitioner also submits that the petitioner was simultaneously remanded in connection with another case, namely, Saharsa Sadar P.S. Case No.399 of 2017, in which he
Patna High Court Cr.Misc. No.41382 of 2017 (2) dt.21-09-2017 2/2 has already been granted bail.
In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sri S.K. Modi, learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S. Case No.158 of 2017. (Anjana Mishra, J) PNM U T
