The petitioner seeks bail in Sadar Muzaffarpur P.S. Case No. 445 of 2020, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

1435.320 litres of foreign liquor has been recovered from Bolero vehicle and pick-up van.

It is submitted that petitioner is not named in the FIR and his name has surfaced in this case on the disclosure made by the co-accused persons who were apprehended by the police. Petitioner neither owner nor driver of vehicles in question and no recovery has been made from conscious possession of this

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Sadar Muzaffarpur P.S. Case No. 445 of 2020.
