JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date : 02-08-2019 This application under Article 227 of the Constitution of India has been filed by the petitioner for directing the learned Additional District Judge-1st, Jamui to dispose of Title Appeal No.16 of 2014 expeditiously.
2. It is submitted by the learned counsel for the petitioner that initially Title Appeal No.16 of 2014 was filed in the court of District Judge, Jamui, which, on transfer, came to the court of 3rd Additional District Judge, Jamui on 16.09.2016. The petitioner, who is plaintiff-appellant is regularly appearing, the defendants-respondents-opposite parties are evading to appear before the court. Even after publication in newspaper, the court below is not fixing the case for ex parte hearing and still the case is pending for appearance of the opposite parties.

3. Keeping in mind the submissions made above, the learned Additional District Judge-1st, Jamui is directed to dispose of the Title Appeal No.16 of 2014 on merits, in accordance with law, as early as possible, preferably within six months from the date of the order.
