The petitioner seeks bail in Buxar (T) P.S. Case No. 556 of 2020, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. As per the prosecution case, on secret information that some miscreants are travelling in Scorpio vehicle in suspicious condition near SBI ATM near Ambedkar Chowk a raid was conducted and five accused persons including petitioner were apprehended on the spot. On search, mobiles, Aadhar Car and several ATM cards were recovered from possession of this petitioner. Illicit liquor was also recovered from the said Scorpio vehicle.

It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.27751 of 2021(3) dt.22-11-2021 2/2 petitioner has falsely been implicated in this case. No incriminating article has been recovered from possession of this petitioner. Other co-accused persons have been granted bail by this Court vide order dated 24.07.2021 passed in Cr. Misc. No. 25951 of 2021, dated 05.08.2021 passed in Cr. Misc. No. 27114 of 2021. Petitioner is in custody since 20.12.2020. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Buxar in connection with Buxar (T) P.S.
