The petitioner is in custody since 31.01.2018 in connection with Sherghati P.S. Case No. 50 of 2017 for the offence registered under Sections 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the first information report but subsequently, his name has surfaced on the basis of the confessional statement made before the police by co-accused namely, Rizwan @ Rizu Khan @ Rizwan Kha, which has no evidentiary value. It is further submitted that the petitioner has not been placed on T.I. Parade and there is no recovery from the conscious possession of the petitioner.
Patna High Court Cr.Misc. No.36851 of 2018 (2) dt.11-07-2018 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No. 50 of 2017.
