The petitioner apprehends his arrest in Kotwali P.S. Case No. 47 of 2013 registered under sections 420, 406 of the Indian Penal Code.

The informant gave a letter to the S.H.O.

alleging therein that he handed over Rs. 15000/ to the petitioner for depositing the same in Insurance Company but money was not deposed and petitioner misappropriated the amount. Learned counsel for the petitioner submits that petitioner was commission agent of the Insurance Company. The informant did not pay the commission and some dispute arose. There is no chit of paper to show that the petitioner has received any money from the informant.

No.32803 of 2014 (2) dt.03-02-2015 2/2 Considering the fact that the informant did not attach any chit of paper to show that the petitioner has received any money, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Patna in Kotwali P.S. Case no. 47 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
