====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 13-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Goraul P.S. (Kathara O.P) Case No. 194 of 2021 lodged under Sections 302/34 of Indian Penal Code.

The allegation made in the F.I.R. is based on hearsay and the informant has made 6 persons as accused. Learned counsel for the petitioner submits that there is no eyewitness of the occurrence and his name along with other 5 named accused has narrated in the F.I.R. only on the basis of suspicion. It has been further submitted that other co-accused persons namely Krishna Rai and Bachhu Rai have been granted bail by the Co-ordinate Bench of this Court vide order dated 13.05.2022 and 05.07.2022 passed in Cr. Misc. No. 72277 of

Patna High Court CR. MISC. No.17326 of 2022(2) dt.13-07-2022 2/2 2021 and 12772 of 2022 respectively.

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances of this case that petitioner is in custody since 10.01.2022, charge sheet has already been filed and name of the petitioner has figured in the case on suspicion and with a view to maintain the parity, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1, Vaishali at Hajipur in connection with Goraul P.S (Kathara O.P) Case No. 194 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
