The petitioner apprehends his arrest in Sabour P.S. Case No. 98 of 2013 registered under section 307 and other allied sections of the Indian Penal Code.

The Officer in-charge Sabour P.S. Alleged that he got information that a truck met with an accident in which one Mukesh Kumar Jha was killed. When the petitioner went there many people came there and pelted stone. They were damaging the public vehicle.

Learned counsel for the petitioner submits that the petitioner was a member of mob and similarly situated accused Binod Mandal has been enlarged on anticipatory bail vide order dated 10.01.2014 assed in Cr. Misc. No. 38530 of 2013.

No.32817 of 2014 (2) dt.03-02-2015 2/2 Having considered the fact that similarly situated co-accused Binod Mandal has been enlarged on anticipatory bail, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Bhagalpur in Sabour P.S. Case No. 98 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
