JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. 60 liters of country made liquor was recovered when one Kishundeo Mahto was apprehended who disclosed that he works on the wages of `200/- per day and manufactures the liquor at the behest of the petitioner.

It is submitted by learned counsel for the petitioner that admittedly recovery has not been made from the petitioner as seizure list does not suggest that it has been recovered from the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.25552 of 2015 (2) dt.01-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran, Chapra in connection with Doriganj P.S. Case No. 56 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
