====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 09-11-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Section 38 of Bihar Excise Amendment Act, 2016.
It is contended that, as per allegation, 3347 liters of foreign liquor were recovered from a Truck. However, the petitioners are not named in the First Information Report. Nothing has been recovered from their Possession. As a matter of fact, the petitioners being transporters/lorry suppliers went to the police station to enquire about the whole episode but they were taken into custody. It is urged that the petitioners are in custody since 19.08.2017. It is claimed that their antecedents are clean.
Patna High Court Cr.Misc. No.50843 of 2017(2) dt.09-11-2017 2/2 Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, West Champaran at Bettiah in connection with Bettiah Muffasil P.S. Case No. 328 of 2017 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
However, one of the bailors must be belonging to the State of Bihar.
