The petitioner seeks bail in connection with Barbigha (Mission) O.P. P.S Case No. 133 of 2018 registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code and Section 8 of POCSO Act. Allegedly, minor daughter of the informant was kidnapped by the petitioner. During investigation the statement of the victim girl has been rerecorded wherein she has not supported the allegation of kidnapping vide Annexure-2. In the facts and circumstances stated above, considering the statement of the victim girl, the petitioner is directed to be released on bail on execution of bail bond of Rs.
Patna High Court Cr.Misc. No.37068 of 2018(2) dt.29-06-2018 2/2 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned 1st Additional District and Sessions Judge, Sheikhpura, in connection with Barbigha (Mission) O.P. P.S. Case No. 133 of 2018 (POCSO Case No. 17 of 2018), subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
