The petitioner seeks regular bail in connection with Kurtha P.S. Case No.05 of 2016 registered for the offences punishable under Sections 328 and 394 of the Indian Penal Code. It has been submitted that this case was registered against four unknown miscreants. In course of investigation, this petitioner was apprehended in connection with Rajgir P.S. Case No.70 of 2016. This petitioner allegedly confessed his complicity in the present crime. The petitioner has neither been put on T.I. Parade nor any incriminating material has been recovered from his possession. The other co-accuseds, who confessed their complicity in the above crime, have been allowed bail by this

Patna High Court Cr.Misc. No.37003 of 2018 (3) dt.19-07-2018 court in Cr.Misc.No.9172 of 2017 and Cr.Misc.No.13655 of 2017. The case of this petitioner stands on similar footing. He is in custody since 24.08.2017 and so he deserves bail. The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge II, Jehanabad in connection with Sessions Trial No.89 of 2018/87 of 2018 arising out of Kurtha P.S.
