The petitioners are apprehending their arrest in a case registered under Sections 406, 420, 323, 504/34 of the Indian Penal Code. The prosecution case, in brief, is that one Sanjay Singh put a proposal before Satyendra Singh, husband of the informant Manju Devi to purchase land @ Rs.9 lacs per bigha. Accordingly Satyendra Singh purchased land from Sumitra Devi for consideration money of Rs.31,50,000/- through registered sale deed. The consideration money was paid through cheque. When the informant and her husband went to the land, they found the land already is in

Patna High Court CR. MISC. No.20254 of 2019(2) dt.02-04-2019 2/2 possession of one Shambhu Chaturvedi. The informant demanded money, whereupon Sanjay Singh stuck to assault and threatened of dire consequences.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The matter relates to land transaction. Money Suit No.6 of 2018 is also pending in respect of the same.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daud Nagar in connection with Daud Nagar P.S. case No.41 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
