The petitioner is seeking anticipatory bail in connection with Dawath P.S. Case No. 146 of 2018 registered under Sections 30(A)/35/38 of the Bihar Prohibition & Excise Act, 2016.

learned counsel for the petitioner submits that as per allegations the petitioner had fled away after leaving the PickUp Van from which illicit liquors were recovered. Learned counsel submits that this petitioner is neither the owner nor the driver of the vehicle in question but has been falsely implicated at the instance of the persons inimical to him. Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner.

No.16706 of 2019(2) dt.28-03-2019 2/2 Considering the facts and circumstances of the case wherein the petitioner is neither the owner nor the driver of the vehicle in question and there is no other material to connect him for the present in this case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd cum Special Judge, Rohtas at Sasaram, in connection with Dawath P.S. Case No. 146 of 2018, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
