The petitioner seeks bail in connection with Ishipur Barahat P.S. Case No. 26 of 2017 dated 05.05.2017 instituted for the offences under Section 302 of the Indian Penal Code read with Section 27 of the Arms Act.

The father of the informant died as a result of firing resorted to by the petitioner.

The informant as well as the deceased had gone to attend the marriage function where the petitioner is said to have opened fire for celebrations. In the second round of firing, the muzzle was pointed towards the deceased and accidentally the deceased was hit by the bullet. There was no intention of the petitioner to kill the deceased.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIII, Bhagalpur in connection with Ishipur Barahat P.S. Case No. 26 of 2017, G.R. No. 2132 of 2017.
