1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Yadopur P.S. Case No. 80 / 2024 dated 27.05.2024 registered under Sections 341, 324, 326, 307, 34 of the I.P.C.
3. As per the first information report on 27.05.2024 in the afternoon when the informant's son aged about 14 years was coming back from school near Saran bandh the petitioner along with other accused persons accosted him, assaulted him and gave knife blow to him. The informant's son was stabbed for 30-40 times.
4. Learned counsel for the petitioner submits that petitioner has been made accused in this case due to previous land dispute as would be evident from F.I.R. itself. Both the parties are close door neighbours having land dispute. The allegation against the

5. In this case vide order dated 16.04.2025 case diary was called for by this court which has been received and kept on record. From perusal of the case diary it appears that Investigating Officer has not obtained injury report from the concerned hospital at Gorakhpur where the victim was treated.
6. Learned counsel for the State submits that it is true that case diary does not contain injury report.
7. I have heard learned counsel for the parties and has perused the case diary. The occurrence has taken place on 27.05.2024 and since then more than one year has passed but the police has failed to obtain injury report. From perusal of the supervision note at paragraph no. 26 of the case diary it appears that the supervising authority has noted that while the informant's son was coming back from school due to previous land dispute the petitioner and other accused persons surrounded him and started abusing and assaulting him. The co-accused Amit Kumar took out knife and assaulted the informant's son on various body parts due to which he was seriously injured.
8. Considering the fact that allegation against the petitioner is general and omnibus in nature, there is land dispute between the
Patna High Court CR. MISC. No.17412 of 2025(3) dt.14-08-2025 3/3 parties, in the supervision note the supervising authority has noted that it was the co-accused / Amit Kumar who assaulted the victim with knife, accordingly, I am inclined to grant anticipatory bail to the petitioner.
9. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-IV Gopalganj in connection with Yadopur P.S. Case No. 80 / 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
