The petitioner apprehends his arrest in Itarhi P.S. Case No. 61 of 2014 registered under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act. Sheo Muni Singh, the informant, alleged that the petitioner fired which hit on the ankle of the informant. Learned counsel for the petitioner submits that there is a land dispute between the parties. There is a case and counter case. On account of firing made by the petitioner, simple injury is caused to the informant.

Having considered the allegation that there is an allegation against the petitioner that he fired causing injury on the ankle of the informant, I am not inclined to enlarge the petitioner on anticipatory bail in Itarhi P.S. Case No. 61/2014. Accordingly,

Patna High Court Cr.Misc. No.32785 of 2014 (2) dt.02-02-2015 2/2 the same is rejected.

The petitioner, if so advised, may surrender in the court below and make prayer for regular bail. The court below shall consider the same without being prejudiced by the present order.
