Petitioner, already in custody, seeks bail in connection with Special Case No.03 of 2017, arising out of Hathauri P.S. Case No.47 of 2017, registered under Sections 272 and 273 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner contends that the petitioner is made accused on the basis of the statement of the chowkidar that every accused persons were naming each other, however, the petitioner is in custody since 04.07.2017 and similarly situated co-accused was earlier admitted to bail by a coordinate Bench of this Court.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.4769 of 2018(2) dt.31-01-2018 2/2 petitioner Jugnu Ojha @ Garibnath Ojha is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Special Case No.03 of 2017, arising out of Hathauri P.S. Case No.47 of 2017.
