JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sarai P.S. Case No. 88 of 2018. for the offenses under Sections 468, 414, 120B IPC and Section 30(a) and 35(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Recovery of liquor was made from the truck. The petitioner was on way to his Sasural and simply because the truck was behind his motorcycle, he was arrested on suspicion that he has connection with the liquor. He submits that the petitioner has no concern with the truck or the liquor. The petitioner is in custody since 19.05.2018. Considering the aforesaid, let the petitioner, above
