====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Dalsingh Sarai P.S. Case No. 394 of 2018, instituted for the offence under Section(s) 272, 273 of Indian Penal Code and Section 30(a) 41(i) of Bihar Prohibition and Excise Act.

Counsel for the petitioner submits that petitioner is in custody since 31.02.2018.

It is alleged in the written report that 165 litres of foreign liquor has been recovered from Scorpio vehicle. Petitioner was found sitting on the aforesaid vehicle. Counsel for the petitioner submits that petitioner has no concern with the aforesaid foreign liquor. He is neither owner nor driver of the vehicle. He has clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III-cum-Special Judge, Excise, Samastipur, in connection with Dalsingh Sarai P.S. Case No. 394 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
