The petitioners are in custody since 30.5.2018 in connection with Dumraon P.S. Case No. 205 of 2018 registered for the offence punishable under Section 30 (a), 41 (1) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent and they are in custody in this case since 30.5.2018. Learned counsel for the petitioners submits that the allegation against these accused- petitioners are that they have assembled there in connection with purchase of liquor. Learned counsel submits that on the aforesaid suspicion petitioners they were apprehended on 30.5.2018. Learned
Patna High Court Cr.Misc. No.39009 of 2018(2) dt.09-07-2018 2/2 counsel further submits that petitioners are students and they have been falsely implicated in this case.
Considering the fact that petitioners have no criminal antecedent and they have remained in custody for more than one month, let the petitioners named above are directed to be released on bail after 15.7.2018 on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each with condition that both bailors should be family members of the petitioners to the satisfaction of the Learned A.D.J. II-cum- Special Judge, Excise, Buxar in connection with Dumraon P.S. Case No. 205 of 2018. (Anil Kumar Upadhyay, J) banti/-T.Kr.
