The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, a raid was conducted and a total of 475.2 litres of IMFL was recovered from the side of the canal while the four accused persons including the petitioner herein managed to escape.
It is submitted by learned counsel for the petitioner that from the F.I.R. itself, it would be evident that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He has no concern with the place of recovery or the seized article. The cause of his false
Patna High Court CR. MISC. No.27542 of 2021(3) dt.26-11-2021 2/2 implication is his antecedent under the Bihar Prohibition and Excise Act, 2016. He is in custody since 19.9.2020. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Raghunathpur P.S. Case no.26 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan.
