Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Maranchi P.S. Case No. 149 of 2022 dated 23.09.2022 lodged under Sections 379/ 414/ 34 of the I.P.C.

As per the prosecution case, the allegation of theft is there in the F.I.R. against the named accused persons. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that the allegation of Section 379 of the I.P.C. is there in the F.I.R. which is magisterial triable in nature. Counsel submits that there is one case pending against the petitioner in which he

Patna High Court CR. MISC. No.16518 of 2023(2) dt.10-05-2023 2/2 is on bail. Counsel also submits that petitioner is in custody since 24.09.2022, whereas charge sheet has already been filed. Counsel further submits that the petitioner is ready to fulfill all the conditions whatsoever be lodged against him and the Sections in which case has been lodged is magisterial triable in nature.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh in connection with Maranchi P.S. Case No. 149 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
