The petitioner is languishing in custody for the offence punishable under Section 363/34 of the Indian Penal Code. Later on offence under Sections 364/120B/302 of the Indian Penal Code was added.
Other named accused persons asked Manoj Kumar Singh, the son of the informant, to bring the petitioner from village Bhaduar. Manoj went to Bhaduar, however, he did not return. During investigation the statement of the petitioner was recorded while the petitioner was in police custody wherein she stated that with the help of others she had managed murder of Manoj.
Learned counsel for the petitioner submits that no one
Patna High Court CR. MISC. No.27416 of 2021(3) dt.28-10-2021 2/2 has claimed to have seen the petitioner along with the deceased at any point of time and confession before the police has no evidenciary value. The petitioner is in custody since 15.12.2020. Learned counsel for the informant opposed the prayer for bail on the ground that on the disclosure of the petitioner mobile phone of the deceased was recovered from the river side. Considering the nature of material against the petitioner and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ladaniya P.S. Case No.179 of 2020 with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
