JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the deceased is languishing in jail custody since 20.06.2016 in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code and earlier his prayer for bail was rejected by this court vide order dated 25.10.2016 passed in Cr. Misc. No. 36324 of 2016 but submission on behalf of the petitioner is that the informant of the present case has been examined in trial court as P.W.3 and he has been declared hostile by the prosecution. Learned counsel for the petitioner further points out that in course of cross examination, the informant admitted that his sister died of her ailment.

No.47147 of 2017 (2) dt.04-10-2017 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VIII, Gaya in connection with Sessions Trial No. 589 of 2016/253 of 2016 arising out of Tekari P.S. Case No. 91 of 2015.
