JUSTICE GOPAL PRASAD ORAL ORDER 15-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. This is a petition for grant of anticipatory bail for the offence under Section 409 of the I.P.C.
The only allegation against the petitioners that they are not submitting the folders with regard to illegal appointment of Panchayat teachers though the last date for submitting the same expired on 15.2.2016.
Learned counsel for the petitioners submits that at the relevant time the said folder of the illegal appointment of the Panchayat teachers were not handed over to the petitioners.
Patna High Court Cr.Misc. No.22028 of 2016 (3) dt.15-06-2016 2/2 Having regard to the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj, in Karakat P.S.Case No.45/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C. as well as they will regularly cooperate in the investigation and noncooperation in the investigation will give liberty to the prosecution to file application before the learned court below to cancel their bail bonds.
