JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A/ 304B/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The accusation is of killing the daughter of the informant after one of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 to the petition. The husband of the victim is in custody.

No.25832 of 2015 (2) dt.17-07-2015 2/2 Considering the retracted version of the informant and husband of the victim is facing trial, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara, Bhojpur in connection with Agaion P.S. Case No.90 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if she defaults for two consecutive occasions or gets involved in some serious nature of offence.
