This is an application for bail in connection with Case No. 259(0) of 2017 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act. Allegation is that there is recovery of 35 litres of Nepali liquor from the tractor and it is said that the tractor is of the petitioners.

Submission of learned counsel for the petitioners is that nothing has been recovered from their possession and they have falsely been implicated in this case and they are in custody since 30.8.2017, having no criminal antecedents.

No.53241 of 2017 (3) dt.17-11-2017 2/2 Having heard both sides and in view of facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cum-Special Judge, Buxar, in connection with Case No. 259(0) of 2017, subject to the following conditions :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) If involvement of the petitioners in such type of cases is found in future, their bail bonds shall be cancelled.
