The petitioner, who is in custody, seeks bail in connection with Govindganj (Malahi) P.S. Case No. 166 of 2017 registered for the offence punishable under Section 387 of the Indian Penal Code and under Sections 4 and 5 of the Explosive Substances Act.

The informant Bhanu Kumar gave a written complaint before the S.H.O. Malahi P.S. stating that on 03.07.2017 at about 6.30 A.M. in the morning when he went to open his shop of stone chips, he found one pressure cooker tied with the tape in a suspicion condition and thereafter he informed the police and police came there and thereafter, the bomb squad

Patna High Court Cr.Misc. No.52277 of 2017 (2) dt.09-11-2017 2/2 was called who found three small bombs wrapped with Sutali. Learned counsel for the petitioner submitted that he has falsely been implicated in this case on basis of suspicion only. FIR is against unknown. Informant suspects that who had demanded extortion money of 10 lakh from him may be involved to terrorize the informant. It has further been submitted that the name of the petitioner has transpired on confession made by Shatrughan Sah and except said confessional statement not incriminating article has been recovered from the petitioner and he is in custody since 19.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Govindganj P.S.
